Any person who wishes to access and/or use the Services that we provide, may do it so as long as the General Terms and Conditions are followed, together with all other policies and principles that govern these Services. In consequence, all visits, all agreements, all transactions made on this Site, the general agreement to Social97 Services, as well as their legal effects, shall be governed by these rules and will be subject to the applicable legislation in Puerto Rico and in the United States of America.
The Client/User must read, understand and accept all the conditions established in the General Terms and Conditions, and in the Social97 Privacy Policies.
1. About the services.
The CLIENT must give access to SOCIAL 97 on his Fan Page. If you do not have a fan page, one will be created for you at no additional cost. If you do not have Instagram, you must create an account and connect it to your Fan Page for publishing content.
SOCIAL 97 will optimize the CLIENT'S Fan Page with the information provided by the CLIENT.
SOCIAL 97 will make 3(three) postings and 3(three) stories per week for the Fan Page, and these will be published in the CUSTOMER Instagram, if it exists and is linked to his Fan Page.
SOCIAL 97 will create one(1) biweekly cover for the CUSTOMER's Fan Page.
The content created for the social networks (Facebook and Instagram) will be developed according to the information provided by the CLIENT at the beginning of the service.
SOCIAL 97 plans the content to be published in each page with one week in advance, so the CLIENT must notify at least 10 days in advance if he/she wants a special post for a specific day.
The design and creation of logos or graphic arts for your business is an additional service, not included, and must be requested separately.
This service does not contemplate the handling of interactions such as comments, private messages (inbox) or shares in the Facebook or Instagram of the CLIENT by SOCIAL 97.
SOCIAL 97 is not a service focused on generating paid traffic (Facebook Ads) but rather a basic service of organic content. For service plans with paid ads (Facebook Ads), the CLIENT must request a consultation.
2. Use policy
The CUSTOMER is the only one responsible for the content and guarantees its authenticity at the time of making it available for the online marketing service, adhering at all times to the current intellectual property legislation and the local laws of Puerto Rico and the United States (USA). This leaves SOCIAL 97 free of any legal responsibility for the use of content, images, videos, etc.
The CLIENT will be responsible for the damages that may be derived from the claims that may be made by a third party, and that have their direct cause in errors of the CLIENT in the execution of any Contract, Sale or its Services.
The CLIENT will collaborate with SOCIAL 97 in the process of correcting the content. The CLIENT must monitor the content and request in advance the modifications that he considers in writing via e-mail. This refers to changes in publications in its information and / or content.
The CLIENT is the only one responsible for determining if the services that constitute the object of this Contract are adjusted to its needs, therefore SOCIAL 97 does not guarantee that the service provided will be adjusted to the specific needs of third parties.
3. Relationship between the parties.
By virtue of this contract, the parties declare the commercial nature of the same, stating that there is no link or dependency, that they do not become associates or partners, nor do they establish any relationship other than that contemplated in the terms and conditions of this instrument.
In this act, SOCIAL 97 and the CLIENT agree to establish an agreement for the purpose of safeguarding the information provided by both parties on a reciprocal basis during the provision of the services covered by this contract, therefore, the parties undertake to maintain absolute confidentiality at the time of signing this contract.
5. Range and positioning.
By virtue of the semantic definition of any of the efforts, the achievement of any of the following objectives is not guaranteed under any circumstances
a) A given position for any expression or keyword in any search engine or directory
b) A number of followers on social networks, registered users, comments or any by-product of user interaction on social networks.
c) A number of net or gross visits derived from the efforts.
d) Any other quantitative targets not set out in this Agreement.
SOCIAL 97 is not responsible for problems derived or originated by any external service managed by any entity unrelated to our service, such as platforms, suppliers or social networks.
SOCIAL 97 is not responsible for damages caused by computer viruses, virtual attacks, hacking, negligence of the CUSTOMER, fire or electrical failure of the systems involved.
The failures, modifications or malfunction of the products or services of the CUSTOMER will be immediately communicated to SOCIAL 97 by the CUSTOMER via email.
7. Of the offers and promotions.
Due to the nature of the offers, trial periods and special promotions, these are extraordinary and limited services and opportunities, therefore the CLIENT will be able to enjoy them only once and these will not be available at the time of renewing the monthly payment or in the future to activate the service again.
8. ElectrumNet and Social 97 Referral Plan.
If the CUSTOMER is a member of the ElectrumNet system having his membership of $20/month a day and refers a new customer to the SOCIAL 97 service, he will receive the commission of $20(twenty dollars) in each beginning of the cycle of his referral, as long as his membership and his own service of SOCIAL 97 are active and respecting the other conditions of the ElectrumNet system. 9. Non-Competition Agreement.
The CUSTOMER agrees that it will not directly hire or have any business relationship with any employee or former employee of SOCIAL 97 for the management or publication in their social networks, during or after the cancellation of the service.
10. Communication Channels.
SOCIAL 97 provides customer service 7 days a week through email firstname.lastname@example.org by phone at (787) 349-8599 Monday through Saturday from 9:00am - 5:00pm (EST time).
The CUSTOMER agrees to use the email email@example.com as the only written communication channel for the proper provision of service. Verbal communications, by WhatsApp or through any other email other than the one indicated above, are not appropriate channels to receive instructions on the provision of the service.
11. Legal Regime.
In the event of any dispute, disagreement, application or interpretation of this Agreement, the parties expressly submit to the courts and tribunals of Puerto Rico or the United States, waiving any other jurisdiction that may be applicable to them. In the event that any of the provisions of this contract is found to be invalid or void, this does not affect the validity of the contract or any of the other provisions or agreements contained in this contract.
12. About payments.
To this end, the CUSTOMER agrees to pay the amount of $97 (ninety-seven dollars) per month to the contracted party for the creation and development of content for its social networks, starting today and at the beginning of each cycle. The CLIENT is responsible for keeping his/her monthly payments up to date.
ANY PERSON THAT DOES NOT ACCEPT THESE GENERAL TERMS AND CONDITIONS, WHICH HAVE AN OBLIGATORY AND BINDING NATURE, SHALL REFRAIN FROM USING THE SERVICES.
